What happens to a mortgage payment when someone dies

When someone dies, the mortgage payment still needs to be made. In most states, it is allowed for either the estate or the beneficiary of the estate to continue to make the mortgage payments. Probate law allows for assets of the estate to make the payments until the estate is settled.

Please keep in mind, that all rules of the current loan agreement still apply. If the payment is late or missed, noone's credit would be affected. However, if the payment is not made, the bank will foreclose as usual.

I recommend you call a probate or an estate attorney. For specifics on mortgage questions you can contact us at anytime.
